Do
you know when you need a license to export?
A
license from the Department of Commerce, the Office of
Foreign Assets Control, or the Department of State may be needed for an export.
Although only a relatively small percentage of total
U.S. exports and reexports require a license, it is
critical that companies understand the regulations to
avoid making illegal exports, which can result in fines,
imprisonment, and loss of exporting privileges.
License
requirements depend upon such things as your item's
technical characteristics, the destination, the end user,
and the end use. You need to consider:
- What
are you exporting? (Are your products classified?)
- Where
are you exporting them to? (What are the embargoed countries?
Did you check the country lists?)
- Who
will receive your items? (Are they on any of the government
denial lists?)
- What
will your item be used for? (Is the end user involved
in proliferation activities?)
If
it is determined that a license may be required, have you
checked if a license exception may be available to you?
